2.2 - Supplying Content and Materials
Clients are responsible for providing any necessary content required for their website, social media, or advertising campaigns unless otherwise agreed. This may include text, images, logos, branding materials, or product/service information.
The Digital Fix is not responsible for delays caused by missing or late content provided by the client.
2.3 - Communication and Feedback
Clients agree to respond to requests for feedback, approvals, or information in a timely manner. Delays in communication may result in project timelines being extended.
2.4 - Platform Access
Where required, clients must provide appropriate access to relevant platforms such as website hosting accounts, social media profiles, advertising accounts, or analytics tools in order for The Digital Fix to deliver services.
2.5 - Legal Compliance
Clients are responsible for ensuring that any content, materials, or information they provide do not infringe on copyright, trademarks, or any applicable laws and regulations.
2.6 - Advertising Budgets
Where online advertising services are provided, clients are responsible for covering the advertising spend required for campaigns unless otherwise agreed. Advertising budgets are separate from service fees charged by The Digital Fix.
3.1 - Service Fees
All fees for services provided by The Digital Fix will be clearly outlined in the proposal, quotation, or agreement provided to the clientbefore any work begins.
By accepting a proposal or confirming a service, the client agrees to the associated fees.
3.2 - Payment Terms
Payment terms will be specified in the service agreement or invoice. Unless otherwise stated, invoices must be paid within the agreed payment periodstated on the invoice.
The Digital Fix reserves the right to pause or delay work if payment is not received within the agreed timeframe.
3.3 - Deposits
For certain services, including website design or larger digital projects, The Digital Fix may require an upfront deposit before work begins. This depositsecures the project start date and covers initial project preparation.
Deposits are non-refundable unless otherwise agreed in writing.
3.4 - Advertising Spend
Where advertising services are provided (such as Google Ads or social media advertising), the advertising budget itself is the responsibility of the client andis separate from the service fees charged by The Digital Fix.
The Digital Fix is not responsible for advertising spend costs or billing handled directly by advertising platforms.
3.5 - Late Payments
The Digital Fix reserves the right to suspend services or withhold project deliverables until any outstanding payments have been received.
3.6 - Changes to Scope
If a client requests work that falls outside the original scope of the agreed services, additional charges may apply. Any additional work will be discussedand approved with the client before proceeding.
3.7 - Refunds
Due to the nature of digital services, payments made to The Digital Fix are generally non-refundable once work has commenced.
Deposits paid to secure project work or service bookings are non-refundable, as they reserve time and resources for your project.
If a project is cancelled by the client after work has begun, the client will remain responsible for payment of any work completed up to the dateof cancellation.
For ongoing services such as social media management or advertising management, clients may cancel future services with reasonable notice, howeverpayments already made for completed work are non-refundable.
Refunds may only be issued at the discretion of The Digital Fix in exceptional circumstances.4.1 - Ownership of Work
All designs, content, strategies, and digital assets created by The Digital Fix remain the intellectual property of The Digital Fix until full payment for the relevant services has been received.
Once full payment has been made, the client will receive the agreed deliverables and may use them for their business purposes as outlined in the service agreement.
The Digital Fix reserves the right to remove or disable work delivered to the client if payments remain outstanding.
4.2 - Use of Third-Party Platforms and Materials
Some services provided by The Digital Fix may involve the use of third-party platforms, tools, or resources (such as website platforms, stock images, fonts, or advertising platforms). Any rights associated with these materials remain subject to the terms and licensing conditions of the respective providers.
The Digital Fix is not responsible for restrictions imposed by third-party platforms or providers.
4.3 - Portfolio and Promotional Use
The Digital Fix reserves the right to display completed work, including websites, marketing materials, and project outcomes, within portfolios, case studies, and marketing materials for promotional purposes unless otherwise agreed in writing with the client.
Client Content
Any content, materials, branding assets, or information provided by the client remain the property of the client. By providing these materials, the client confirms they have the legal right to use them and grant permission for The Digital Fix to use them in order to deliver the agreed services.
5.1 - Limitation of Liability
The Digital Fix provides digital marketing services with the aim of helping businesses improve their online presence and reach more customers. While every effort is made to deliver high-quality work and effective strategies, The Digital Fix does not guarantee specific business results, including but not limited to increases in sales, enquiries, website traffic, or advertising performance.
The Digital Fix shall not be held responsible for any loss of revenue, loss of business, loss of data, or any indirect or consequential losses that may arise from the use of our services.
Many services provided by The Digital Fix rely on third-party platforms, including but not limited to website platforms, social media platforms, search engines, and advertising networks. The Digital Fix cannot be held liable for issues caused by changes, outages, policy updates, or technical problems related to these third-party platforms.
While The Digital Fix will take reasonable care when developing websites and managing digital campaigns, we cannot guarantee that websites, platforms, or online services will always operate without interruption, error, or technical issues.
By using the services of The Digital Fix, the client acknowledges that digital marketing outcomes can vary and agrees that The Digital Fix is not liable for business performance or results beyond the services directly provided.
6.1 - Client Cancellation
Clients may cancel services provided by The Digital Fix by giving written notice via email or another agreed communication method.
For ongoing services such as social media management or advertising management, clients may cancel future services with reasonable notice. Any work already completed or scheduled prior to cancellation will remain payable.
6.2 - Project Work
For project-based services such as website design or one-off digital projects, cancellation after work has commenced will result in the client being responsible for payment for all work completed up to the cancellation date.
Deposits paid to secure project work are non-refundable, as they reserve time and resources for the project.
6.3 - Termination by The Digital Fix
The Digital Fix reserves the right to suspend or terminate services if:
• Payment invoices remain unpaid
• A client fails to provide required information or materials needed to complete the work
• Communication with the client becomes unreasonably delayed or unresponsive
• A client requests work that is unlawful, unethical, or outside the agreed scope of services
6.4 - Outstanding Payments
If services are terminated, the client remains responsible for paying any outstanding fees for work already completed.
6.5 - Completion of Work
Upon termination of services, any completed deliverables may be provided to the client once all outstanding payments have been settled.
7.1 - Governing Law
These Terms and Conditions shall be governed by and interpreted in accordance with the laws of England and Wales.
Any disputes arising from or relating to the use of the website or services provided by The Digital Fix shall be subject to the exclusive jurisdiction of the courts of England and Wales.
